June 2, 2015: The New Cookie Law and Our Solution

Every website owner must now meet new legal obligations, on top of the existing ones under the Privacy Law. Here's our solution for staying compliant.

2017 update

This article dates back to 2015, and the Privacy Policy issue is (unfortunately) still a hot topic. For almost all our clients, we recommend [Iubenda.com](http://bit.ly/2huspzw), a service that drastically cuts legal costs.

Who it applies to

If your site uses Google Analytics, social buttons to "like" and share your pages on Facebook, or if you have an e-commerce system, then you're using cookies and this law applies to you directly.

If you want to learn more about what cookies are on websites, here's a technical explanation from Wikipedia

In detail

This new law requires transparent handling of the data collected through cookie scripts on your site: it becomes mandatory to inform all visitors to your site about the cookies in use and give them the option to refuse third-party cookies.

To meet this legal obligation, your site needs to be updated with information banners and cookie control tools.

Our solution

We recommend Iubenda because it offers a ready-made, legally compliant solution that's easy to implement on your site.

This service, at a cost of €19 per year [^pricing], adds to the privacy management service (required since 2003) that Iubenda already offers and that we recommend to our clients to bring their sites into compliance.

This external solution takes at most one or two hours of one-time implementation work and brings many benefits:

  • No need for legal counsel, since the privacy policy provided complies with current law
  • Iubenda automatically applies any changes to the legislation
  • Texts are translated into English, saving hours of translation work
  • It handles the interaction with users, who accept the policy simply by scrolling or clicking on the page.

Details of Iubenda's solution are available on their website

Fines

Any failure to comply with the Cookie Law and the Privacy Law can, following an inspection by the Italian Data Protection Authority (Garante della Privacy), lead to a fine of €10,000 to €120,000 for the website owner.

If you'd like to adopt our solution to bring your site into compliance, or if you have any questions, contact us for a consultation and we'll help you make this compliance process as smooth as possible.

We'll soon publish an in-depth technical post on some good practices we're discovering for this situation, which is new for pretty much everyone!

[^pricing]: the price refers to a PRO license for the beta version. The price of the official version has not been announced yet. Please check their website for accurate pricing information.
